1. Acceptance of Terms

By accessing or using the IQGAME platform (the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and IQGAME ("we," "us," or "our"). By using the Service, you represent that you have the legal capacity to enter into these Terms, or if you are a minor, that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Description of Service

IQGAME provides an online platform offering cognitive assessment tests across 8 cognitive dimensions: Logical Reasoning, Working Memory, Processing Speed, Visual-Spatial, Verbal Reasoning, Numerical Reasoning, Creative Thinking, and Executive Function. The Service includes:

• Interactive cognitive tests with timed questions
• Performance scoring based on the T-Dimension algorithm
• Percentile-based rankings comparing user performance with aggregated data
• Achievement badges and progress tracking
• Educational content about cognitive dimensions and assessment methodology

The Service is designed exclusively for entertainment and personal self-exploration. Our cognitive tests are not standardized, validated, or approved for clinical, educational, or professional assessment purposes. Results should not be used to make decisions about education, employment, medical treatment, or any other consequential matter.

3. User Eligibility

The Service is available to users of all ages; however, the following conditions apply:

• Minors Under 18: Users under the age of 18 must obtain parental or legal guardian consent before using the Service. By allowing a minor to use the Service, the parent or guardian agrees to these Terms on behalf of the minor and accepts full responsibility for the minor's use of the platform.
• Children Under 13: In compliance with the Children's Online Privacy Protection Act (COPPA) and similar regulations, children under 13 may only use the Service with direct parental or guardian supervision and consent. Parents or guardians must review our Privacy Policy before allowing a child to use the platform.

• Not use the Service for any unlawful, fraudulent, or harmful purpose
• Not attempt to reverse-engineer, decompile, or disrupt the Service's algorithms or infrastructure
• Not create automated scripts or bots to interact with the Service
• Not share, distribute, or publish test content or questions in any form that would compromise the integrity of the assessments
• Not attempt to manipulate test results or scoring algorithms
• Comply with all applicable laws and regulations when using the Service
• Ensure that any minors using the Service under your supervision do so with appropriate guidance

5. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, icons, images, audio clips, data compilations, software, test questions, scoring algorithms, and the design, selection, and arrangement thereof — are the exclusive property of IQGAME or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes only. This license does not include:

• The right to modify, reproduce, distribute, or create derivative works from any content on the Service
• The right to use any data mining, robots, or similar data gathering or extraction methods
• The right to download or copy any portion of the Service, except as expressly permitted
• The right to use the Service for commercial purposes without explicit written authorization

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• No Liability for Test Results: IQGAME shall not be liable for any decisions made, actions taken, or consequences arising from the use of test results. Our tests are for entertainment purposes only and are not intended to be, and should not be construed as, medical, psychological, psychiatric, educational, or professional advice of any kind.
• No Liability for Accuracy: While we strive to provide engaging and well-designed cognitive tests, we make no guarantees regarding the accuracy, reliability, completeness, or validity of any test results, scores, percentile rankings, or other outputs generated by the Service.
• No Consequential Damages: In no event shall IQGAME, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of (or inability to access or use) the Service; (b) any conduct or content of any third party on the Service; (c) any content obtained from the Service; or (d) unauthorized access, use, or alteration of your transmissions or content.
• Maximum Liability Cap: In no event shall our total liability to you for all claims arising out of or relating to the Service exceed the amount of USD $1.00 (one dollar), or the amount you paid to IQGAME for the Service during the twelve (12) months prior to the claim, whichever is greater.
• Assumption of Risk: You acknowledge and assume all risks associated with your use of the Service and any reliance on its outputs.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

To the fullest extent permitted by law, IQGAME disclaims all warranties, express or implied, including but not limited to:

• Non-Clinical Disclaimer: The Service is NOT a clinical, medical, psychological, or psychiatric instrument. It has not been validated or approved by any medical, psychological, or educational regulatory authority. Test results should not be used for diagnosis, treatment, or any clinical decision-making.
• Implied Warranties: Implied warranties of merchantability, fitness for a particular purpose, and non-infringement are expressly disclaimed.
• Accuracy and Reliability: No warranty is made regarding the accuracy, reliability, or validity of test results, scores, percentile rankings, or other outputs.
• Uninterrupted Service: No warranty is made that the Service will be uninterrupted, timely, secure, or error-free.
• Virus-Free: No warranty is made that the Service or its servers are free of viruses or other harmful components.

No Guarantee of Results: IQGAME does not guarantee any specific outcome, result, or benefit from using the Service. Cognitive test results are influenced by numerous factors including but not limited to test conditions, user attention, fatigue, mood, and environmental distractions. Results may vary between sessions and should not be considered definitive measures of cognitive ability.

8. Indemnification

You agree to defend, indemnify, and hold harmless IQGAME and its officers, directors, employees, agents, licensors, and suppliers from and against any claims, actions, demands, liabilities, and settlements including legal fees arising from:

• Your use of the Service in violation of these Terms
• Your misuse of test results, including but not limited to representing them as clinical or professional assessments
• Your violation of any applicable law or regulation
• Your violation of any rights of another party, including intellectual property rights
• Any content you submit, post, or transmit through the Service

This indemnification obligation will survive the termination of your use of the Service and these Terms.

9. Modifications to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. When we make changes:

• We will post the revised Terms on this page.
• For material changes, we will provide a prominent notice on our website prior to the change taking effect.

Your continued use of the Service after any changes to the Terms constitutes acceptance of the new Terms. If you do not agree to the modified Terms, you must discontinue use of the Service.
